外籍教練員聘用協(xié)議書(shū)(中英文）

AGREEMENT OF EMPLOYMENT OF FOREIGN COACH

甲乙雙方本著(zhù)自愿、平等的原則，經(jīng)過(guò)友好協(xié)商，達成以下聘任協(xié)議，以使甲乙雙方共同遵守：

This Agreement is hereby made and concluded by and between Guangdong Football Center (hereinafter referred to as “PARTY A”) and Marcelo Moraes Duarte (hereinafter referred to as “PARTY B”), on the principle of equality and mutual benefit.

 

一、協(xié)議期限Period of Validity

本協(xié)議有效期自 年 月 日至 年 月 日，自雙方簽字蓋章之日起生效。

This Agreement shall come into effect on the date when it is signed by the two parties and is valid from    until    .

 

二、體檢、醫療及保險Physical Examination, Health Care and Insurance

（一）乙方在與甲方簽訂本協(xié)議之同時(shí)，必須提供健康證明。如發(fā)現乙方患有不適合在甲方工作的嚴重疾�。ㄓ杉追叫惺骨笆鰢乐丶膊≈�具體內容的解釋權），本協(xié)議將自動(dòng)解除，甲、乙雙方均不再承擔履約責任。

Part B must show the health certificate before signing this Agreement. If PARTY A finds PARTY B has the serious disease (the right for explaining the definition of “the serious disease” belongs to PARTY A), which will affect the work described below, this Agreement will cease, and both sides of PARTY A and PARTY B will no longer conform to this Agreement.

 

（二）如乙方在甲方工作期間患病，至甲方下屬康復中心就診，予以免費治療；如乙方至其他任何醫院就診，需經(jīng)甲方同意，否則，乙方自行承擔所有醫療費用。

Free of charge to access to the clinic of PARTY A is; if, without the permission of PARTY A, PARTY B will be responsible for all the costs in any other hospital.

 

（三）甲方不為乙方提供任何保險。PARTY A will not provide any insurance for PARTY B.

 

三、權利和義務(wù)Rights and Duties

（一）甲方權利和義務(wù)Rights and Duties of PARTY A

1、向乙方支付薪金每個(gè)月稅后6，000美元。具體的支付方式為：在乙方簽訂合同抵達廣州后，先向乙方預支薪金總額的30%，余下的薪金按月支付。

The monthly salary for PARTY B shall be 6,000 US dollars (Six Thousand US Dollars) after tax, in the way as 30% (Thirty Percent) of the total payment shall be paid to PARTY B upon his arrival in Guangzhou with the signature of this Agreement. The rest of the payment will be paid monthly.

 

2. 負責承擔乙方及其家屬一共5人在協(xié)議期內各1次巴西—廣東—巴西的機票費用（經(jīng)濟艙）。

One Round-Trip Economic Airfare between Brazil and Guangdong shall be provided for PARTY B and his family members as 5 persons in total herein within the validity of this Agreement.

 

3、根據隊伍訓練和比賽的具體安排，給予乙方每周1天的假期，期間可安排到市區游玩（當天伙食標準另定）。

A One-day leave per week shall be guaranteed to PARTY B in accordance with the training and competition schedule of the Teams. Proper sightseeing in Guangzhou could be offer with adjusted dinning arrangement if possible.

 

4、向乙方提供基地宿舍樓的免費住宿及運動(dòng)員飯堂的免費就餐；在乙方家屬到來(lái)期間，免費提供一個(gè)月的基地宿舍樓住宿及運動(dòng)員飯堂就餐。

Free food and lodging in the training base shall be offered to PARTY B, which shall also be offered to the family members of PARTY B for one month during their stay in Guangzhou.

 

5、力所能及地負責乙方因工作所需的開(kāi)支。其中，電話(huà)及其他通訊設施的使用費用由乙方自理。

PARTY A shall take an affordable part of working expenditures of PARTY B, but not including bills of telephone or any other telecommunication service.

 

6、依照甲方的規章制度和要求，對乙方進(jìn)行管理和考核。甲方對乙方嚴重違反協(xié)議及本單位管理規定的行為，視情節給予罰款、降薪直至解除工作協(xié)議的處罰。

It is of PARTY A’s right to conduct supervision and assessment on PARTY B under the rules and regulations of PARTY A. If there is any violation by PARTY B against the items of this Agreement or the rules and regulations hereinbefore, punishments, reduction of salary and the cease of this agreement shall be imposed.

 

（二）乙方權利和義務(wù)Rights and Duties of PARTY B

1、擔任四支隊的體能教練，指導隊伍開(kāi)展體能訓練。

To be employed as the Physiologist of four teams ,  instructing the physical training of the Teams.

 

2、每周工作6天，工作時(shí)間應全身心投入工作。

PARTY B shall devote himself to the work during the six working days per week.

 

3、工作期間的薪金為每個(gè)月稅后6，000美元，并享受甲方提供的往返機票費用、假期、食宿等福利待遇。如甲方在明年全運會(huì )順利完成奪取兩塊金牌的任務(wù)，乙方將獲得額外獎勵10，000美元。

PARTY B enjoys the benefits of the monthly salary of 6,000 US dollars (Six Thousand US Dollars) after tax, one free round-trip airfare, one-day leave per week and free food and lodging in the training base. PARTY B shall be rewarded 10,000 US Dollars (Ten Thousand US Dollars) as extra bonus once PARTY A achieve the goal of winning two gold medals in the Football Competition of the 12th National Games in 2013.

 

4、遵守中華人民共和國的各項法律、法規及相關(guān)的規章制度，接受甲方的管理和考核。

PARTY B shall be subject to the laws and regulations of People’s Republic of China and the relevant rules, supervision and assessment of PARTY A.

 

四、終止與違約處罰  Termination and breach punishment

本協(xié)議到期自然終止。如需續約，甲、乙雙方另行協(xié)商。此外，經(jīng)甲、乙雙方協(xié)商一致，可以解除本協(xié)議；乙方如有嚴重違反中國法律法規及甲方規章制度等行為，甲方可以解除本協(xié)議；甲方如有以非法手段強迫乙方從事違法、違紀活動(dòng)及拖欠乙方薪金等行為，乙方可以解除本協(xié)議。如甲乙雙方因故解除本協(xié)議，乙方須向甲方返回預支的相應薪金。

This Agreement shall terminate upon the expiration of the validity hereinbefore. For the extension or the cease of this Agreement, two parties shall have further consultation. It is of PARTY A’s right to cease this Agreement in the situation that there is any gross violation by PARTY B of the laws and regulations of China or the rules and regulations of PARTY A hereinbefore; and it is of PARTY B’s right to cease this Agreement in the case of the violation of the laws and rules by PARTY B under the compulsion of PARTY A and the default on salary by PARTY A. PARTY B shall refund the amount of prepaid salary to PARTY A once this Agreement is terminated upon any reasons raised by both parties.

 

五、 其他約定 Miscellaneous

本協(xié)議書(shū)中文、英文各一式兩份，每方執中、英文各一份。如本協(xié)議英文版的內容與中文版內容不同或沖突，均以中文版的內容為準。未盡事宜雙方另行協(xié)商解決。

This Agreement shall be made in four originals (two in English and Chinese respectively) that shall be held by each party. CHINESE version will prevail over the ENGLISH one if they come in conflict with each other. The other matters that have not been covered in this Agreement shall be supplemented through further mutual consultation.
